Clarity Street maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Clarity Street If you do not agree to these terms, do not use this Site.
Use of Site
Clarity Street supplies various materials, information, quizzes, knowledge checks, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”).
Clarity Street authorises each User (enrolled student) to view and download one copy of the Materials.
Materials may be downloaded and a maximum of one copy of the Materials may be printed if Users make no modifications to the Materials, and you keep all copyright and other proprietary notices contained in the original Materials on any copies of the Materials.
Users may not modify the Materials at this Site in any way or reproduce, share or distribute them.
Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity.
Any breach of these Terms of Use automatically terminates your authorized use of the Site.
Enrolled Student
Enrolled student means any student enrolled in one or more courses.
No enrolled student may share their login details with any other person, enrolled student or not.
An enrolled student is any individual that has purchased one or more courses and is enrolled in those purchased courses.
Geographic Location
If you, as a User, purchase Materials from this Site or Clarity Street while outside of Australia, you may not use or access the materials while in Australia.
User Warranty
As a User you warrant that you are not an agent or employee of any other test preparation company or online course provider and the Site and Materials are solely for the purpose of professional education and training.
Trademark and Copyright
Clarity Street, and certain other brands, trademarks, and service marks are marks of Clarity Street and its affiliates. The Materials on this Site are copyrighted, and any unauthorised use of any Materials on this Site may violate copyright, trademark, and other laws.
Hyperlinks
Links to external websites are supplied solely as a convenience to you. Clarity Street has not reviewed all these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk.
No Warranty
The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Clarity Street further does not warrant the accuracy and completeness of the Materials at this Site. Clarity Street may make changes to the Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be out of date, and whilst we endeavour to make regular updates, Clarity Street makes no commitment to update the Materials at this Site.
Limitation of Liability
In no event will Clarity Street, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites linked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment, data changes, process changes, or software changes and settings, you assume all costs thereof.
Applicable Law
The Terms of Use are governed by the laws of the province of Victoria, Australia. Failure to enforce strict performance of the Terms of Use shall not be construed as a waiver of any provision or right. Clarity Street may assign its rights and duties under the Terms of Use without notice to any party at any time.
Effective Date and Updates
The Terms are effective as of 1 July 2021 and are subject to change without notice by Clarity Street at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
Refund and Cancellations
You will be eligible for a full refund of fees paid ONLY if Clarity Street cancels the nominated course before you have logged in to access the course.
If you, the student, decide to cancel within the 7-day money-back guarantee period, please note there is an admin fee of $25 (to cover processing fees/set up fees we incur). If you have incurred additional late/failed payment fees with our payment plan provider, you will need to pay these fees in full (which may be more than $25).
Clarity Street does not offer full refunds outside of the 7-day period under any circumstances due to our significant intellectual property and goodwill. If you have further questions, please contact us at: [email protected].
Non-completion
No refund of fees or release from financial commitment will be granted for the non-completion of studies.
Course Expiry and Access
You can continue to access your course online allowing:
- The course is still active on our website
- The course is not currently being reviewed or improved
- You have logged in at least once in the previous 12 months; AND
- You have paid your account in full
- Your firm's engagement period with Clarity Street has expired.
Unlimited Access to enrolled courses
Permitting your enrolled course access is current (see above), your Clarity Courses access is just that: unlimited. That means you may repeat any course as often as desired.
Collection and Use of Personal Information
Clarity Street collects and uses personal information for the following purposes:
Supply information about you only to Clarity Street’s approved list of partners (consultants or contracted third parties including mentors and employers) where considered appropriate for the purposes of helping you, to effectively manage your progress, and to support your individual needs (all third parties will abide by this Privacy Policy & Notice and the Australian Privacy Principles)
Supply information, products and services to you and request information to manage and administer those products and services (including enrolment, assessment and issuing certificates
Respond to your queries relating to Clarity Street's website, its products, advice and services
To better understand your needs, and help us to improve our products and services
Internal record keeping
Circulation of promotional emails about new products and services, special offers or other information which we think you may find interesting (you may opt-out at any time)
Contact you for market research or direct marketing purposes (you may opt-out at any time)
Customise the website according to your interests and needs; and
Customise documents according to your business needs
Clarity Street may contact you via a variety of measures including by telephone, email, or SMS. All communications from Clarity Street will be via your contact details recorded on file. You may also engage with Clarity Street via various social media platforms, which collect and store your personal information and data. It is your responsibility to keep your details up to date. You may update your contact details or preferred method of communication, unsubscribe, or opt-out of any marketing communications by contacting Clarity Street at any time.
Disclosure of Personal Information
Clarity Street may disclose your personal information under the following circumstances:
- Supplying third parties (including employers and mentors) with information about your progress
- Supplying information, products, and services to clients
- To register and administer events, promotions, or competitions
- To verify personal information details upon request from third parties, such as completion of courses, a request from a potential employer verifying a qualification and further enrolment into another institution
- In the case of students under 18 years of age:
- information about attendance, progress and general well-being may be supplied to keep parent(s) and/or guardian(s) informed
- To credit reporting agencies and courts, tribunals, regulatory authorities where students do not pay for goods or services provided by us to them
- To courts, tribunals, regulatory authorities, and law enforcement officers as required by law, in connection with any actual or prospective legal proceedings, or to establish, exercise or defend our legal rights
- To one or more Consultants for the purpose of supplying information and services to you
- To the relevant third party or parties, with our client’s consent, if the matter involves third parties; and
- To third parties, including agents, referral partners, the Australian Institute of Personal Trainers (AIPT) (32363), Foundation Education (22557), contractors and sub-contractors for the purposes of providing information, products and services to you. This may include parties located, or that store data, outside of Australia. All third parties will abide by this Privacy Policy & Notice, the Australian VET Data Policy, and the Australian Privacy Principles
If there is a change of control of the Clarity Street business, sale, or transfer of business assets, we reserve the right to transfer to the extent permissible at law, Clarity Street user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser. Clarity Street would seek to only disclose information in good faith and where we have sought to maintain confidentiality.
Clarity Street does not typically, or routinely disclose personal information to overseas recipients unless the overseas recipient is a contracted third party acting on behalf of the organisation, or an exception under the Australian Privacy Principles applies. Clarity Street will only disclose personal information to overseas recipients where reasonable steps have been taken to ensure the overseas recipient does not breach Clarity Street Privacy Policy & Notice, or the Australian Privacy Principles.
